Many criminal defense attorneys are former state prosecutors, but very few have been on the other side of federal charges. Federal offenses are completely different from crimes committed at the state level.
These cases are handled in a different court that uses its own set of procedures. In addition, people who are convicted of a federal crime face the prospect of much more severe penalties.
Daniel Conidi, our managing partner has the knowledge to challenge the admissibility of wiretaps, informant testimony, undercover audio/video recordings, search warrants because he actually developed these kind of cases for the federal government as a Senior Special for both Homeland Security and the U.S. Department of Justice. He knows where the mistakes are often made and can effectively assess the government’s case and proceed confidently from there. This is a big advantage that the other lawyers just do not have.
If you are facing charges for any federal offense, it is essential that you seek the advice of an experienced federal criminal defense attorney immediately. At Alliant Law Chicago we provide aggressive, thorough representation to people who have been charged with a federal crime.
POTENTIAL SENTENCES FOR FEDERAL CRIMES
In Federal Court, sentences are determined and imposed exclusively by a United States District Court Judge. The Judge makes a sentencing determination after consulting the United States Federal Sentencing Guidelines and reviewing each defendant’s particular background and criminal history, as well as the circumstances surrounding the offense. Sentences are also influenced by whether the defendant pleaded guilty, by whether a defendant has provided cooperation to the government, or whether the defendant went to trial.
Individuals convicted in federal court may be sentenced to serve time in prison, to serve time in home-confinement, to perform community service, to pay fines and/or restitution, and/or to serve a period of supervised release with conditions such as drug treatment. Parole has been abolished in the federal system.
PRE-INDICTMENT INVESTIGATIONS AND INTERVIEWS
Agents from the DEA, FDA, FBI, Homeland Security and other federal law enforcement agencies commonly contact suspects prior to bringing charges in an effort to get the suspect to confess, to provide incriminating information or to provide information against other individuals in order to avoid charges themselves or to lessen their potential sentences. You should NEVER speak to law enforcement without a lawyer!! Even if you believe you have done nothing wrong, you can place yourself at great risk by speaking with law enforcement. Remember, though Agents will promise you leniency for speaking with them, they cannot normally make deals on behalf of the U.S. Attorney’s office, and they are allowed to lie to you under the law in order to get you to confess!! An experienced federal criminal defense lawyer can help you make the decision about whether you should speak with law enforcement and can help you do so under circumstances where your rights are protected.
DO NOT TALK TO LAW ENFORCEMENT AGENTS WITHOUT YOUR EXPERIENCED FEDERAL CRIMINAL DEFENSE LAWYER!! AND NEVER CONSENT TO A SEARCH OF YOUR HOME OR VEHICLE WITHOUT A WARRANT. FINALLY, ALWAYS DEMAND TO SPEAK TO YOUR LAWYER!
The best time to get a criminal defense lawyer is as soon as you become aware of the federal investigation. This is when a criminal defense lawyer can help most. Depending on the circumstances, it may or may not be in your best interest to cooperate with the federal government. In some situations, early cooperation and exchange of information can result in a significant reduction in prison or even the complete avoidance of prosecution. But, this decision should be made with caution. A skilled criminal defense lawyer can ensure any deal you make is in your best interest. Additionally, a lawyer can ensure that any decision made by you will be done with a clear understanding of the potential benefits and consequences.
